This Privacy Policy explains:

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. This Privacy Policy applies alongside our Terms & Conditions.

Personal Information We Collect

We only collect personal information that we reasonably need for our business activities. The information depends on how you deal with us.

Information collected automatically

When you visit our Site, we or our service providers may automatically collect:

• general location (such as city or region);
• device, browser and operating system details;
• pages viewed and links clicked; and
• the date and time of your visit.

Customers and business enquiries

When you submit our contact form or email us, we collect:

• your name;
• your company name;
• your email address;
• your phone number (optional); and
• anything you include in your message, such as volumes, pack formats and delivery requirements.

Harvest updates

When you subscribe to our seasonal harvest updates, we collect your email address.

Seasonal workers and new starters

When you complete our online induction, we collect:

• your first, middle and last name;
• your date of birth;
• your phone number and email address;
• an emergency contact;
• your country of passport origin and visa or work rights information;
• your driver's licence number and a copy of your driver's licence;
• your Medicare number and a copy of your Medicare card;
• the name of your labour hire contractor;
• the position you are applying for;
• your induction answers and declaration; and
• a head-shot photo for your staff ID card.

Some of this information, such as identity documents and visa details, is sensitive. We only collect it with your consent. We only use it to confirm your identity and your legal right to work, to meet our workplace, safety and food safety obligations, and to issue your ID card.

How We Use Personal Information

We use personal information only for the purposes set out in this Privacy Policy or explained at the time we collect it.

We use information collected automatically to understand how our Site is used and to improve it.

We use customer and enquiry information to:

• respond to supply, wholesale and compliance enquiries;
• quote, supply and deliver fruit; and
• manage our business relationships.

We use your subscription email to send harvest news and seasonal updates, which is around eight emails a year. You can unsubscribe at any time using the link in each email or by contacting us.

We use seasonal worker information to:

• verify identity and work rights;
• complete inductions and onboarding;
• coordinate with your labour hire contractor;
• manage workplace health and safety, including contacting your emergency contact if needed;
• meet our HARPS, Freshcare and food safety requirements; and
• meet our legal obligations under Australian employment, tax and migration laws.

We will not use government identifiers such as your Medicare or driver's licence number as our own way of identifying you.

Who We Share Personal Information With

Our team

We only give personal information to members of our team who need it to do their job.

Third parties

We may share personal information with:

• labour hire contractors we work with, such as Manpower and Agri Groups, for workers they place with us;
• our sales and distribution partners, such as Aus Berry Farmers and Farmers Fresh, where needed to handle orders and deliveries;
• certification and audit bodies, such as HARPS and Freshcare auditors, where they need to review our records;
• service providers who help us run our Site and business, such as website hosting, form processing, email and IT providers; and
• government agencies, where required for visa, work rights, tax or workplace compliance.

These parties only receive the information they reasonably need for that purpose.

Other disclosures

We will never sell your personal information. We may disclose it:

• if the law requires it;
• in connection with legal proceedings;
• to establish or protect our legal rights; or
• to a buyer or potential buyer of our business.

Overseas disclosure

Some of our service providers, such as website hosting and email providers, may store data on servers outside Australia. Where this happens, we take reasonable steps to make sure your information is protected to a standard consistent with the Australian Privacy Principles.

Links to other sites

Our Site may link to other websites. We are not responsible for their privacy practices.

How Long We Keep Personal Information

We keep personal information only for as long as we need it for the purpose we collected it, or as long as the law requires. For example, some employment records must be kept for at least seven years under the Fair Work Act 2009 (Cth). When we no longer need the information, we will securely destroy or de-identify it.

How We Protect Personal Information

We take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification and disclosure. These include:

• encrypted connections (HTTPS) on our Site;
• secure storage with reputable providers; and
• limiting access to the people who need it.

Identity documents and work rights information are given extra care, and access is restricted.

No method of transmission over the internet is completely secure. We cannot guarantee the security of information beyond what is reasonably practicable. If a data breach is likely to cause serious harm, we will notify affected people and the Office of the Australian Information Commissioner as required by law.

Children

Our Site and services are intended for adults. All workers must be 18 or over before starting work with us. We do not knowingly collect personal information from anyone under 18. If we learn that we have, we will delete it as soon as possible. A parent or guardian can contact us at the address below.

Accessing, Correcting or Deleting Your Information

You can ask us:

• what personal information we hold about you;
• how we have used or disclosed it; and
• to correct, update or delete it.

To make a request, email admin@jmberryfarms.com.au. We will respond within a reasonable time, usually 30 days. We may need to verify your identity first. In some cases we may be legally required to keep certain information, such as employment records, and we will explain this if it applies.
