These terms and conditions (the "Terms") govern your use of jmberryfarms.com.au (the "Site"). The Site is owned and operated by JM Berry Farms ("we", "us", "our"), a family-owned strawberry grower based in the Yarra Valley, Victoria.

By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

About the Site

The Site provides information about our farm, our fruit, our partners, our workplace policies and our certifications. It also lets you:

• send supply, wholesale, compliance and seasonal work enquiries;
• subscribe to our harvest updates; and
• complete our online induction if you are starting work with us.

We do not sell products or take payments through the Site.

Supply Enquiries

Information on the Site about our fruit, seasons, availability, volumes, grading and pack formats is general in nature. Seasonal conditions change, so availability can change too.

Nothing on the Site is an offer to supply. Submitting an enquiry does not create a contract. Any supply of fruit is subject to a separate agreement, quote or order confirmed in writing by us or by our sales and distribution partners, and the terms of that agreement will apply.

Certifications and Policies

We publish details of our HARPS and Freshcare certifications and our workplace policies for your information. We aim to keep them current. If you need to rely on certification status for compliance purposes, please check with the relevant certification body or contact us for current documents.

Online Induction

If you complete our online induction, you agree that:

• the information and documents you provide are true, current and your own;
• you have read and understood the induction handbook and site rules; and
• you will bring your confirmation on your first day as instructed.

Completing the induction does not by itself guarantee employment or a placement. Your engagement is subject to your labour hire contractor's arrangements, verification of your work rights and our site requirements. Providing false or misleading information may result in your engagement not proceeding or ending.

Harvest Updates

If you subscribe to our harvest updates, we will send you seasonal news by email. You can unsubscribe at any time using the link in each email or by contacting us.

Acceptable Use

When using the Site, you must not:

• use it for any unlawful purpose;
• submit false, misleading or someone else's information;
• upload anything containing viruses or harmful code;
• attempt to gain unauthorised access to the Site or its systems; or
• interfere with the Site's operation or security.

Intellectual Property

All content on the Site, including text, photographs, logos, graphics and downloadable documents such as our induction handbook, is owned by or licensed to JM Berry Farms. You may view and download content for your personal use or for dealing with us. You must not copy, reproduce, publish or use it for any other purpose without our written permission.

Third-Party Websites

The Site may link to websites operated by others, including our partners and certification bodies. We do not control those websites and are not responsible for their content, policies or practices. Please read their terms and privacy policies before using them.

Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot be excluded. If there is a conflict between these Terms and that law, the law applies.

Limitation of Liability

We try to keep the Site accurate and available, but we do not guarantee that it will be error-free, uninterrupted or free of viruses.

To the extent permitted by law, JM Berry Farms and its owners, employees and agents are not liable for any loss or damage arising from your use of, or reliance on, the Site. This includes indirect or consequential loss.

Where our liability cannot be excluded but can be limited, it is limited to resupplying the relevant service or paying the cost of having it resupplied.

Indemnity

To the extent permitted by law, you agree to indemnify JM Berry Farms and its owners, employees and agents against any claims, losses, damages or costs, including reasonable legal costs, arising from your breach of these Terms or your misuse of the Site.

Governing Law

These Terms are governed by the laws of Victoria, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Victoria.

Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be removed. The rest of these Terms will continue to apply.

Changes to These Terms

We may update these Terms from time to time to reflect changes in the law or how we operate the Site. We will post the updated Terms on this page and change the effective date. Continuing to use the Site after a change means you accept the updated Terms.
